Meeting with Your Workers Comp Lawyer

When you are ready to meet with a lawyer about your workplace injury and workers compensation, there are some things you can bring with you to make the legal process go smoother and quicker, saving you time and money. Bringing the proper documentation is the first step to getting a favorable settlement.

Personal Information

The workers comp lawyer will need to know some basic information about you such as full name, address, and daytime and evening telephone numbers. Also expect the lawyer to ask about your personal background such as place of birth, education, marital status etc. Some lawyers have standard questionnaires or forms to complete, so it is a good idea to ask if you could complete them in advance of your meeting.

Employer Information

Be sure to bring information about your place of work such as the name of your employer, the name of your supervisor, address and telephone numbers, and health and workers compensation insurance carriers. Also bring the names of any witnesses to your injury. This information is useful in preparing your case, but it also allows the attorney to identify any potential conflicts of interest up front. If the law firm is representing anyone who may be a conflict of interest, that firm will not be able to represent you. Most lawyers will be able to refer you to another attorney.

Workplace Injury Information

The most important documentation to bring is regarding your injuries. A good practice, starting from the time of your injury, is to document as much as you can. We all think we will remember every detail later, but the truth is that over time the details fade, so document the injury, your treatment, medications, dates of treatment, and recovery times.

The following list is a good starting point of what you should bring to your lawyer:

• Personal identification
• Information about your medical insurance coverage
• Description of the your injury and the circumstances in which the injury occurred
• Copies of any workers compensation claim forms filed
• Copies of any medical claims forms filed
• Copy of any accident reports or police reports (if applicable)
• Copy of hospital or doctor records of your initial treatment
• Copies of doctors reports for diagnosis, prognosis and subsequent visits
• Copies of bill for treatment of from health care providers
• If possible, information about expected future medical costs
• The amount of time you have missed from work as a result of your injury
• A listing of all the ways your life has been affected by your injury
• A calendar, with all of the important dates: date of your injury, dates of treatments or surgery, dates of therapy, medications provided and when, etc.
• Copies of correspondence with insurance companies with dates and descriptions of the type of interaction (phone, letter, fax, etc.)
